Who we are

Psyke is run by Hill Capital Enterprises LLC, a Michigan limited liability company doing business as Psyke. In these terms, we, us and Psyke mean that company. You means the person using Psyke.

These terms cover psyke.trade and any Psyke app.

Accepting these terms

By creating an account or using Psyke, you agree to these terms. If you don't agree, don't use Psyke.

The Privacy policy at psyke.trade/privacy explains what we do with your data.

Who can use Psyke

You must be 18 or older. If we learn an account belongs to someone under 18, we delete it.

One account per person, for your own use. Use a real email address you check, because that's where we send notices. Keep your password to yourself.

You're responsible for what happens in your account. If you think someone else got in, email hello@psyke.trade straight away.

What Psyke is

Psyke is a journal. You write your trading rules, grade your sessions, import your trade exports and set goals. Psyke counts how your behaviour matched your rules and shows it back to you, including your Psyke Issue: the habit your own entries point to most.

For each pattern it finds, Psyke also shows a short pre-written note: what the pattern usually means, what it usually costs, and a habit to try. The notes are the same for everyone, and they're about process, never about a trade.

Psyke's figures are calculations from what you entered or imported. They're only as accurate as those entries.

What Psyke is not

Psyke doesn't act as a broker, trading platform, commodity trading advisor, investment adviser or prop firm. It isn't registered with the CFTC, the NFA, the SEC or any other regulator.

Psyke never tells you what to trade, when, or how much. It gives no signals, places no orders and connects to no trading account.

Nothing in Psyke is financial, investment, trading, tax or legal advice. You make every trading decision, and you're responsible for it.

Psyke is not therapy, counselling or medical care. Your Psyke Issue is a pattern in your trading behaviour, not a medical or psychological diagnosis. If you're in crisis, call or text 988 in the US, or your local emergency number.

Futures trading carries substantial risk of loss and isn't suitable for everyone. Psyke doesn't promise you'll pass an evaluation, get funded, get a payout or make money.

Prop firms and platforms

Psyke isn't affiliated with, endorsed by or sponsored by any prop firm, broker, exchange or trading platform. We name them only to identify the firms whose published rules, and the platforms whose export files, Psyke can read. Their names are trademarks of their owners.

Firm presets in Psyke are our summaries of each firm's published rules as of when we last checked them. Some come from third-party sources and are marked unverified. Firms change their rules, so confirm the numbers with your firm before you rely on them.

Imports read the file your platform exports. Check that your trades came through correctly.

You're responsible for following your firm's and platform's rules, including any rules about the tools you use.

Your content

You own what you put into Psyke: rules, grades, notes, goals, settings and imported files.

You let us store, process and show that content to run Psyke for you, keep it safe and improve Psyke. That permission ends when you delete the content or your account, apart from backups, which clear within 30 days.

Unless you object, you also let us use your trade data (the trades you import and the trade details you enter, from 9 September 2026 on), with your identity removed, for research and to build aggregated or de-identified datasets we may license to others, as the Privacy policy describes. Those datasets never include your name, email, user ID, account numbers, files or notes, and we never try to re-identify anyone. To object, email hello@psyke.trade, and we leave your data out of every dataset we build after that. Datasets built before you object or delete your account stay in use, because they can't be linked to you.

Only import files you have the right to share. You're responsible for the accuracy of what you enter.

Using Psyke fairly

Don't share your account, resell Psyke, or let other people use it through your account.

Don't scrape, copy or reverse-engineer Psyke, test it for weaknesses without our permission, or get around its limits or plan restrictions.

Don't upload malware, anything illegal, or other people's data without their permission.

Don't use Psyke to break the law or to harm anyone.

Plans

Free — grade every session and see your last 7 days. No card.

Core — the full record, your Psyke Issue, reminders and the weekly review. Monthly or yearly.

Pro — not on sale yet.

Core can also be unlocked with an access code we give you. That doesn't need a card, and ends if we withdraw the code.

Current prices are on psyke.trade/pricing, in US dollars. If tax applies, you'll see it before you pay. Anything marked 'coming' isn't part of a plan until it launches.

If you stop paying, nothing is deleted. On Free, Psyke shows your last 7 days, your full record stays in your data download, and all of it is back when you return to Core.

Free trial

Core starts with a 30-day free trial, on the monthly or the annual plan. You add a card to start it. Nothing is charged during the trial.

When the trial ends, your card is charged the Core price you picked, and the plan renews automatically until you cancel.

Cancel any time before the trial ends and you pay nothing. We email you at least 7 days before it ends.

Renewal and billing

Paid plans renew automatically at the end of each month or year. Your card is charged the plan price at the start of each new period until you cancel. There's no minimum term.

Stripe handles payments. Your card details go to Stripe, not to us. While you're on a paid plan, your invoices are in Settings > Manage billing.

If a payment fails, Stripe retries it for a while and your plan stays on meanwhile. Nothing is deleted.

Promotion codes are personal, have no cash value, and can be withdrawn if misused.

Cancelling

Cancel any time, online, in Settings > Manage billing > Cancel. You don't need to call or explain. Or email hello@psyke.trade and we'll cancel it for you. It counts as cancelled when your email reaches us, and if we charge you after that, we refund it.

Cancelling stops all future charges. You keep your plan until the end of the period you've already paid for, or until your free trial ends, and then your account moves to Free. Your record stays.

Deleting your account also cancels your plan, straight away. See Ending your account.

Refunds

Cancelling stops the next charge.

Think we charged you by mistake? Email hello@psyke.trade with the date and amount.

Nothing here limits any refund right the law gives you.

Price changes

We may change our prices. A new price never applies to time you've already paid for.

We email you before it applies to your plan, and it starts at your next renewal. If you don't want it, cancel before then.

EU and UK

If you live in the EU or UK, you keep any right to withdraw, cancel or get a refund that your law gives you.

Services we rely on

Psyke runs on other companies' services, and an outage at one of them can affect Psyke.

Links to other sites are there for convenience; we don't control them.

Changes to Psyke

Psyke changes as we build it. We may add, change or remove features.

Anything marked coming, beta or waitlist, including Pro, may change or never launch. You're not paying for it.

If we shut Psyke down, we'll email you first so you can download your data.

Our property

Psyke's software, design, name and logo belong to us. While your account is open, you have a personal, non-transferable right to use Psyke under these terms. Nothing else transfers to you.

Feedback

If you send us ideas or suggestions, we can use them freely, without paying or crediting you.

Ending your account

You can delete your account any time in Settings > Delete account. It deletes your data as the Privacy policy describes and cancels your plan straight away. If you have paid time left, email hello@psyke.trade before you delete. Deletion can't be undone, so download your data first.

We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires it, or to protect Psyke or other people.

Parts of these terms meant to last continue after your account ends, including the research permission for datasets already built, No warranties, Limits on liability and Law and disputes.

No warranties

We work to keep Psyke accurate and running.

As is — We provide Psyke as is and as available. As far as the law allows, we don't promise it will be uninterrupted, error-free, of merchantable quality or fit for a particular purpose, or that its figures, imports or firm presets are accurate or complete.

Limits on liability

Trading losses — As far as the law allows, we're not liable for trading losses, lost profits, failed evaluations, lost payouts, or any indirect or consequential loss, however it's caused.

Cap — As far as the law allows, our total liability to you for all claims about Psyke is limited to the greater of what you paid us in the 12 months before the claim, or US$100.

Nothing in these terms limits liability the law doesn't allow us to limit, such as for fraud, or for death or personal injury caused by negligence. If you're a consumer in the EU or UK, you keep your mandatory rights.

If you break these terms

If someone makes a claim against us because you broke these terms or the law, or because of something you uploaded, you'll cover our reasonable costs and losses from it, as far as the law allows.

Law and disputes

Michigan law governs these terms, apart from its conflict-of-law rules.

If something goes wrong, email hello@psyke.trade first. Most problems get fixed that way.

If we can't settle it, either of us can bring a claim in the state or federal courts located in Kent County, Michigan, and we both accept those courts. Either of us can use small claims court instead if the claim qualifies.

If you're a consumer in the EU or UK, you can also bring a claim in the courts where you live, and your country's mandatory consumer protections still apply.

Changes to these terms

We may update these terms. If a change matters, we email you before it applies and update the date at the top.

If you keep using Psyke after that, the new terms apply. If you don't agree, cancel or delete your account first.

The rest

These terms, and any terms shown to you when you buy a plan, are the whole agreement between us about Psyke. The Privacy policy explains how we handle your data. If a court finds part of these terms unenforceable, the rest still applies. If we don't enforce something straight away, we can still enforce it later.

You can't transfer these terms to someone else. We can transfer them to a company that takes over Psyke, and we'll tell you if that happens.
